Trademark Registration in Argentina: How Does It Work?

Registering a trademark in Argentina means filing with the INPI (Instituto Nacional de la Propiedad Industrial), Argentina’s national trademark office, under Trademark Law No. 22,362. You don’t need to be a resident, travel to Argentina, or notarize a Power of Attorney for filings before INPI — a scanned, signed authorization is enough. Formal notarization only applies if a matter moves beyond INPI, for example to court. If INPI raises no objections and no third party opposes your application, registration is typically granted in 3 to 4 months; contested or delayed cases can run 8 to 14 months. Once granted, protection lasts 10 years and is renewable indefinitely.

WHY TIMING MATTERS

Argentina Generally Follows a First-to-File Trademark System

As a general rule, priority is determined by the filing date of the trademark application. Prior use may be relevant in certain circumstances, particularly in disputes involving bad faith or superior rights, but it does not replace registration or automatically confer exclusive rights.

Until your trademark application is filed in Argentina, a competitor, local distributor or bad-faith third party may seek registration first, potentially creating avoidable legal obstacles, additional costs and commercial uncertainty. Early filing is therefore essential to securing priority and protecting your brand in the Argentine market.

FREQUENTLY ASKED QUESTIONS

Everything clients ask us before filing

What can be registered as a trademark in Argentina?

Argentine Trademark Law No. 22,362 allows registration of words, logos, slogans, monograms, packaging, and non-traditional signs such as sounds or shapes. Logo registration is included in our filing fee at no extra cost.

How much does it cost to register a trademark in Argentina?

Official INPI fees are set in UMAPI units, a reference value INPI adjusts periodically, so any fixed number published today could be outdated within months. Our professional fees scale with how many trademarks and classes you're filing. The most accurate way to know your exact cost is a free, no-obligation quote calculated on the current UMAPI value and your specific filing.

How long does the process take?

When INPI raises no objections and no third party opposes your application, registration is typically resolved in 3 to 4 months. Contested cases, or periods of administrative backlog at INPI, can extend that to 8-14 months. Your filing date is locked in the moment we submit your application.

Can I claim priority under the Paris Convention?

Yes. If you filed an application in another Paris Convention country within the previous 6 months, you may claim that date as your priority date in Argentina. A certified Spanish translation of the priority document must be submitted within 90 days of the filing date.

Do I need to live in Argentina to register a trademark?

No. Ownership doesn't require residency or citizenship. Argentine law does require a legal domicile in the country for official notifications, which we provide as part of our representation.

How long does protection last once granted?

10 years from the approval date, renewable indefinitely in additional 10-year periods as long as the mark stays in use.

Who can apply for trademark registration in Argentina?

Any individual or legal entity with a legitimate interest may apply for trademark registration in Argentina, regardless of nationality or place of residence, subject to the requirements of Argentine trademark law.

Do I need a registered trademark to sell on MercadoLibre or protect my brand online?

In most cases, yes. MercadoLibre's brand protection program, along with most marketplace and customs enforcement tools, requires a locally registered trademark before you can enroll or remove infringing listings.

What if my case takes longer than expected?

Most delays come from INPI's internal workload, not from anything wrong with your application. Your filing date holds regardless, and we respond to any office action at no additional charge.

What is the Mid-Term Declaration of Use, and do I need to file one?

Yes. Argentine law requires every trademark owner to file a sworn declaration confirming the mark is in use. It must be filed after the fifth anniversary and before the sixth anniversary of the registration. We track this deadline and file it as part of our watch service.

Do you work with foreign trademark attorneys and law firms as a local correspondent?

Yes. PROMARCA acts as Industrial Property Agent and local correspondent in Argentina for law firms and trademark attorneys abroad, filing and prosecuting your clients’ marks under your instructions while your client relationship stays yours.

Rates and timelines reflect the process as of 2026; INPI updates its fee schedule periodically.
