Trademark Renewal in Argentina: Deadlines, Use Requirements and UMAPI Fees

A trademark renewal in Argentina requires more than filing a form before the expiration date. Trademark owners must verify the registration’s status, comply with the applicable declarations of use and pay the official fees established by the Argentine National Institute of Industrial Property (INPI).

Since 2026, INPI official fees have been expressed in UMAPIs and updated monthly. Consequently, the amount payable in Argentine pesos depends on the UMAPI value in force on the filing date.

When should a trademark be renewed in Argentina?

An Argentine trademark registration is valid for ten years and may be renewed indefinitely for successive ten-year periods.

The renewal application may be filed:

• During the six months preceding the expiration date; or
• Within six months after expiration, subject to an additional grace-period fee.

Whenever possible, filing before expiration is advisable to avoid additional government fees and reduce the risk of losing the registration through a missed deadline.

What is the official trademark renewal fee?

The standard INPI fee for a trademark renewal is established at 200 UMAPIs.

UMAPI stands for Unidad de Medida Arancelaria de la Propiedad Industrial, or Industrial Property Fee Unit. It is the unit used by the Argentine INPI to calculate official fees for trademarks and other industrial property procedures.

As of August 2026:

• Value of one UMAPI: ARS 397.35
• Standard trademark renewal fee: 200 UMAPIs
• Official renewal fee: ARS 79,470

The number of UMAPIs remains fixed, but its equivalent in Argentine pesos changes monthly according to Argentina’s Consumer Price Index.

Therefore, the final government fee must always be calculated according to the UMAPI value applicable on the actual filing date.

Professional fees and any additional official charges are calculated separately.

How does the UMAPI system work?

The UMAPI was created by INPI Resolution No. 75/2026, published in March 2026.

The new fee schedule became effective on April 1, 2026, and the monthly UMAPI adjustment mechanism became operational on May 1, 2026.

Under this system:

1. Each INPI procedure has a fixed value expressed in UMAPIs.
2. The peso value of one UMAPI is adjusted monthly.
3. The adjustment follows the Consumer Price Index published by INDEC.
4. The updated value applies from the first day of the following month.
5. INPI publishes the current UMAPI value through its online portal.

As a result, quotations for trademark renewals in Argentina must be updated according to the intended filing date.

Is trademark use required for renewal?

Yes. Argentine Trademark Law provides that a registration may be renewed if the trademark was used during the five years preceding its expiration.

The relevant use may consist of:

• Commercialization of the protected goods;
• Provision of the protected services; or
• Use of the trademark as part of a trade or business name.

A declaration confirming use during the five-year period preceding expiration must be submitted as part of the renewal process.

What happens if the mandatory mid-term Declaration of Use was not filed?

The declaration submitted with the renewal is different from the mandatory mid-term Declaration of Use, which must be filed after the fifth anniversary and before the expiration of the sixth year of the registration.

For trademarks granted from January 12, 2013 onward, the mid-term Declaration of Use must have been filed before the renewal application can proceed.

If this mandatory declaration was not filed within the applicable period, the trademark owner must regularize the situation before or together with the renewal application.

In such cases, INPI charges:

• The official fee for filing the overdue mid-term Declaration of Use; and
• An additional late fee for each year of non-compliance.

These fees and accumulated late charges must be paid in addition to the standard trademark renewal fee of 200 UMAPIs.

If the trademark renewal itself is filed after the registration has expired, the corresponding grace-period surcharge must also be added.

Accordingly, the total official cost may include:

• The standard renewal fee;
• The overdue mid-term Declaration of Use fee;
• Accumulated late fees for each year of delay; and
• The grace-period surcharge for a renewal filed after expiration.

For this reason, the registration history should be reviewed before calculating the final cost of an Argentine trademark renewal.

What should be reviewed before filing?

Before filing a trademark renewal in Argentina, it is advisable to verify:

• Registration and expiration dates;
• Current ownership information;
• The owner’s name and address;
• Any pending assignments or corporate changes;
• The classes and goods or services covered;
• Filing of the mandatory mid-term Declaration of Use;
• Use of the trademark during the preceding five years; and
• Whether the renewal falls within the ordinary period or the grace period.

Identifying missing declarations or ownership inconsistencies in advance can prevent delays and unexpected official charges.
